Analysis: Like other investors, Romney enjoys lower income-tax rates

WASHINGTON (Reuters) - Living off your investments is a much better deal tax-wise in the United States than living off of a paycheck, as Mitt Romney's 2011 tax return underscored on Friday.

Days after a secret video showed him scorning the almost 47 percent of Americans who pay no federal income taxes, the Republican presidential challenger disclosed that his 2011 federal tax bill was $1.9 million.

That is a lot of money by any standards, but on an effective basis, Romney's tax rate last year was 14.1 percent. That was much lower than President Barack Obama's, at 20.5 percent, and that of Romney's running mate, Paul Ryan, at 20 percent.

The main reason: Both Obama and his wife, Michelle, and Ryan and his wife, Janna, got about half of their 2011 income from wages. Not so for Romney and his wife, Ann.

The Romneys' 2011 tax return showed adjusted gross income of $13.7 million: $3 million from taxable interest; $3.6 million from dividends; $6.8 million from capital gains; and the balance from other sources. Their wage income? Zero. That largely explains their low effective tax rate compared with that of the Obamas.

Why? The United States over the past 30 years has deliberately favored investment income over wage income, which is taxed at a top rate of 35 percent. In a combination of trickle-down economic theory and raw political power, U.S. investors have won preferred tax-code treatment.

That code has not been fully overhauled in 26 years. In that time, many interest groups have loaded it down with loopholes, exemptions, credits and other complexities, each with political allies determined to protect it. Some of those tax breaks benefit the poor and the middle class, and some the wealthy.

TAXES AND THE ELECTION

The outcome of the November 6 presidential election will go a long way toward deciding if a thorough tax code overhaul will be attempted in years ahead and, if so, what it will look like.

Take carried interest, for instance, a major source of income for Romney.

One of the wealthiest Americans ever to run for the White House, the former Massachusetts governor built a fortune buying and selling companies at Bain Capital as a private equity financier. Those lucrative years gave Romney a tax advantage.

His campaign said in January he got $13 million in income over the last two years from "carried interest," a form of earnings available under the tax code to private equity partners and some hedge fund managers.

The returns show that Romney still has an interest in funds through Bain Capital. The Ann D. Romney Blind Trust lists a long list of Bain-related transactions, for example.

Carried interest is taxed at the 15 percent investment income-tax rate, not the higher ordinary tax rate.

Private equity partners say that is appropriate because there are risks involved in their work. Critics say carried interest is actually closely comparable to wage income.

Obama has proposed curbing the carried interest tax break and taxing these gains at the ordinary income rate, while Romney's position on the issue is still unclear.

Romney's effective tax rate is lower than many high-income wage earners "because of the 15 percent rate on dividends and capital gains and also the fact that much of that income likely comes from carried interest," said Duke University tax law professor Lawrence Zelenak.

The 2011 returns show the Romneys' effective tax rate would have been just over 10 percent if they had taken the full charitable-giving deductions to which they were entitled.

Effective tax rates vary wildly from person to person due to the code's complexity. But counting all U.S. taxpayers, the average income tax rate is 11.8 percent, according to the Tax Foundation, a think tank in Washington, citing Internal Revenue Service data for 2010.

In 2011, about 46 percent of Americans paid no federal income tax, most of them because they were poor or elderly, according to the Tax Policy Center, another think tank.

Almost two-thirds of those who paid no federal income tax did pay federal employment taxes that support the Social Security pension system and the Medicare health program.

Romney's 2011 return also shows a web of investments stretching from the United States to tax-haven jurisdictions such as the Cayman Islands, Luxembourg and the Netherlands.

"This doesn't strike me as a tax situation you'd want to be in if you're running for president - to have pages and pages of these foreign investments. There are many mysteries to these returns," said Zelenak.

After Facebook posts, Pa. hostage-taker surrenders

PITTSBURGH (AP) ? Klein Michael Thaxton hadn't been much of a Facebook devotee. He posted no status updates in two years on the social network. On Friday, though, he surfaced with a jarring post: "i cant take it no more im done bro."

The 22-year-old Army veteran was on the 16th floor of a downtown Pittsburgh office building at the time, armed with a hammer and kitchen knife and holding a businessman hostage, police said.

He surrendered after more than five hours. Neither he nor the hostage, business owner Charles Breitsman, 58, was injured. But Thaxton's real-time Facebook updates ? coupled with online pleas by his friends to surrender ? vividly illustrated the evolving challenges that confront police when social media plays an active role in a crime-in-progress.

In all, Thaxton sent seven messages, many of them despairing and written in disjointed style.

"this life im livin rite now i dnt want anymore," said one post. "ive lost everything and I aint gettin it back."

Thaxton's friends responded by urging him to end the situation peacefully, including one who asked him to think of his mother.

"dude, you gotta purpose here in life, and this ain't it yo, people do care man, they do," another wrote.

Thaxton's mother, Ronda Thaxton, was at the scene working with negotiators. She said she last saw her son several weeks ago and had a feeling he was troubled.

Initially, police wanted his Facebook page kept open, hoping to gain useful information, but they later asked Facebook to take it down so that he could focus on communicating with authorities.

The Facebook exchanges had the potential to help and to harm those efforts, police Chief Nathan Harper said. It was helpful that Thaxton could see "that people are concerned about his well-being," the chief said, but "it is a distraction for negotiating."

Hours into the standoff, Pittsburgh's public safety director, Michael Huss, asked the media to refrain from reporting about the Facebook page, though many outlets had already done so.

Thaxton served as a private in the U.S. Army from December 2008 to June 2010. The Army said he trained at Fort Leonard Wood in Missouri before being assigned to Fort Riley in Kansas.

He also has a criminal record, including a guilty plea to robbery earlier this year in a special county court for military veterans with mental health or addiction problems.

The hostage-taking was the latest striking example of how Facebook and other social media can inject the public into crime dramas in ways that were inconceivable in the pre-Internet age.

In the old days, police would call the telephone company and ask that the hostage-taker's phone number be changed immediately so no one else could call it, said Gary Noesner, a former chief of the FBI's crisis negotiation unit.

In this case, countless people had the ability to communicate with Thaxton, sending him comments and potentially provoking him, "for better or for worse," said Steve Jones, a professor who studies online culture at the University of Illinois at Chicago.

"We don't really know what the perpetrators pay attention to," Jones said. "Is he reading every post? How does he interpret those posts? What might set him off or what might get him to calm down?"

A former criminal profiling expert with the FBI, Mary Ellen O'Toole, said the decision by police to ultimately shut down Thaxton's Facebook page made sense, just as there was reason to leave it up in the beginning.

Investigators determined that Thaxton picked the office at random after noticing through a glass door or window that Breitsman had an iPhone, computer and TV in his office that Thaxton, correctly, believed he could use to call attention to himself, Harper said.

Investigators would like to know why Thaxton wanted to create a public spectacle, Harper said, "but we will leave that to the mental professionals to figure that out and get the man some help."

Thaxton was charged with kidnapping, terroristic threats and aggravated assault and may be charged with escape once police identify the halfway house where he was living after a recent carjacking conviction, Harper said.

Thaxton saw Breitsman's name on an office door and asked for him by name but didn't know Breitsman or have any connection to him, Harper said.

Police spokeswoman Diane Richard said Breitsman was able to meet with his family after Thaxton surrendered a little before 2 p.m.

"He is doing OK at this point, a little shaken up," Richard said.

Facebook did not comment on the Pittsburgh hostage-taking but referred reporters to a page describing how it works with law enforcement. The page says Facebook may share information with law enforcement if deemed necessary to "prevent imminent bodily harm" to someone.

(Reuters) - Sony/ATV, the music publishing division of Sony Corp, has kicked off an auction to sell the rights to more than 30,000 songs from artists ranging from Culture Club to Iggy Pop contained in the Virgin Music and Famous U.K. song catalogs, according to sources with direct knowledge of the process.

These sources said non-disclosure agreements were sent out last week to more than 20 potential buyers, including Warner Music Group, Primary Wave Music, Round Hill Music, Imagem Music, Kohlberg Kravis & Roberts & Co LP, Platinum Equity Partners, Thomas H. Lee Partners and others.

The signing of non-disclosure agreements is typically required at the start of an auction process as a condition of receiving books with detailed financial data about the company being auctioned.

While a first-round bid deadline has not yet been set, the sources said they expect a deal to be valued at around $150 million.

The sale of the Virgin Music and Famous U.K. catalogs were among the concessions required by regulators in order for Sony/ATV to receive approval for its $2.2 billion acquisition of EMI Music Publishing. John Branca, a partner at law firm Ziffren Brittenham who has represented Michael Jackson, Aerosmith, The Rolling Stones, and others, is running the auction on behalf of Sony/ATV.

All parties mentioned above either declined comment or could not be reached for comment.

Combined, the two catalogs control the rights to more than 30,000 songs, the bulk of which are from artists who rose to prominence during the 1980s and 1990s. Included in the catalogs are rights to songs from the Culture Club, Lenny Kravitz, Goo-Goo Dolls, Iggy Pop, Tears for Fears, Fine Young Cannibals, and many others.

Music publishing catalogs can range in size from a few dozen songs to a few million. For instance, Round Hill on Tuesday acquired Arthouse Entertainment, which controlled the rights to just 150 songs from artists including Katy Perry and Cee Lo Green. By contrast, Sony/ATV, a 50-50 joint venture between Sony Corp and the estate of Michael Jackson, ranks as the record industry's largest music publishing house with the rights to more than 2 million songs.

While record labels have struggled with declining CDs sales as a result of piracy and a shift to digital distribution, music publishing companies have gained in value because they collect revenue every time a song is played in any format since they control the underlying rights to the composition.

A faked Phillips Academy Andover transcript with wrong classes and the names of Bowdoin professors for references, for instance, was never verified.The College Board student report personally mailed in by Wheeler himself ? featuring 16 perfect scores on AP tests and a perfect mark on the SAT ?? was similarly never looked at with suspicion. During Wheeler?s time at Harvard, not once did a faculty member notice the incorrect crest on his transcript until it was too late.As a peer of Wheeler?s at Harvard, it seems fair that Zauzmer couldn?t resist a few digs here and there while writing about Wheeler?s time at the school. The report found no evidence that Holder was informed about the Fast and Furious operation before Jan. 31, 2011, or that the attorney general was told about the much-disputed gun-walking tactic employed by the department's Bureau of Alcohol, Tobacco, Firearms and Explosives.

The inspector general found fault with the work of the senior ATF leadership, the ATF staff and U.S. attorney's office in Phoenix and senior officials of Justice's criminal division in Washington. He also said that poor internal information-gathering and drafting at Justice and ATF caused the department to initially misinform Congress about Fast and Furious.

One of those criticized in the report, former ATF acting director Kenneth Melson, who headed that office during the Fast and Furious investigation, retired upon release of the report.

"Melson made too many assumptions about the case," the report said. "Melson should have asked basic questions about the investigation, including how public safety was being protected."

Another of those criticized, Justice Department career attorney Jason Weinstein, resigned. Weinstein was a deputy assistant attorney general in Justice's criminal division in Washington.

"Weinstein was the most senior person in the department in April and May 2010 who was in a position to identify the similarity between the inappropriate tactics used in Operations Wide Receiver and Fast and Furious," the report said.

Weinstein's lawyer, Michael Bromwich, called the report's criticism "profoundly wrong" and "deeply flawed."

An international team of physicists is working to ascertain more about the fundamental physical laws that are at work in a process known as convection, which occurs in a boiling pot of water as well as in the turbulent movement of the liquid outer core of the Earth. The team's new finding specifies the way that the temperature of a gas or liquid varies with the distance from a heat source during convection. The research is expected to eventually help engineers with applications such as the design of cooling systems, for instance, in nuclear power plants.

Guenter Ahlers, professor of physics at UC Santa Barbara, worked with his team at the Max Planck Institute for Dynamics and Self-Organization in Goettingen, Germany, on this important discovery about turbulent convection. The results will be published in the September 7 issue of Physical Review Letters, and are available online now.

The experiments took place in a cylinder that was placed under the turret of a large pressure container. The 8-foot tall cylinder was heated at the bottom and cooled at the top. There were about 100 thermometers inside it, and it was pressurized with sulfur hexafluoride, an inert gas. Convection occurred inside the cylinder because, in the presence of gravity, the warmer gas at the bottom tends to rise to the top, while the colder gas tends to sink.

"We like sulfur hexafluoride because it is harmless not poisonous, not chemically reacting and because it is a heavy molecule," said Ahlers. "A heavy molecule enables us to produce more vigorous convection with the same temperature difference. The strength of the convection is measured by a parameter called the Rayleigh number. We go to Rayleigh numbers as high as 10 to the 15 a million billion which is very large by our standards."

Ahlers enjoys the ability to oversee and even run the continuing experiments remotely on a computer in his office at UCSB (or anywhere else in the world), even though the laboratory is 5,000 miles away.

He explained that convection occurs naturally in astrophysics and in Earth systems. For example, the outer layer of the sun is composed of convection cells. Convection occurs in the Earth's atmosphere and oceans. The liquid iron in the outer core of the Earth undergoes vigorous convection and has Rayleigh numbers well above 10 to the 20. That convection generates the magnetic field of the Earth.

In their paper, the scientists present experimental and numerical data that show that, except for a very thin layer in the immediate vicinity of the plates, the temperature of this system varies linearly with the logarithm of the distance from the confining plates. They discovered this profile and measured it in detail.

The findings are especially intriguing because they echo an important discovery from 1930 by Theodore von Krmn and Ludwig Prandtl, known as the "Law of the Wall." This discovery involved the study of a gas or liquid flowing along a wall, where its speed must be zero at the wall because of friction. The speed of the fluid parallel to the wall increases as the distance from the wall increases. Von Krmn and Prandtl showed more specifically that the speed increases linearly with the logarithm of this distance when the flow is fast enough so that the fluid becomes turbulent. This result is called the Law of the Wall and is of great importance in many engineering applications.

Ahlers compared the new findings about the way temperature varies in convection to the way speed varies with the Law of the Wall, noting that they are similar, although the precise relationship has yet to be understood. "They behave in the same way," said Ahlers. "But just because two things look the same doesn't mean they are the same, so we still need to build the theoretical foundation that connects them. That's what makes this a very active, very exciting field, with theorists as far apart as Beijing (China), Marburg (Germany), and Twente (the Netherlands) already trying to explain the experimental results. You make an experimental discovery, and then theorists get excited. Then they start working on it, and who knows what we will have six months down the road?"

He explained how the Law of the Wall is of importance in engineering applications. "Pumping oil from Alaska down to the United States costs billions of dollars," said Ahlers. "And if you can understand what causes the resistance that you have to overcome, then maybe you can reduce that. Even if you only reduce it by 2 or 3 percent, you've saved hundreds of millions. So it's very, very important."

Ahlers went on to say that understanding the temperature in turbulent convection is also very important because there are many applications where turbulent convection is used to cool things. In nuclear reactors, for instance, cooling is done by turbulent convection. "There are many applications of this turbulent convection system in industry, where you would also like to understand what's going on inside, what the temperature gradients are," he said. "So I can see relevance for this in applications. Although I must say that is not our motivation; our motivation is to understand the fundamental physics."

Eberhard Bodenschatz, one of the authors, was a postdoctoral fellow with Ahlers at UCSB about 20 years ago and is now director of the Max Planck Institute for Dynamics and Self-Organization in Goettingen. Co-author Xiaozhou He is a postdoctoral fellow with Ahlers and is based in Goettingen. Scientists from The Netherlands, Italy, and France are also involved.
