(Reuters) - After heaping criticism on Nasdaq OMX Group's initial offer for compensating brokers for its botching of Facebook's initial public offering, trading firm Knight Capital Group Inc said it accepts the exchange's latest plan, which would pay out $62 million.
The plan, which Nasdaq has called its "definitive word" on the Facebook debacle, is under consideration by the SEC and brings into question the extent to which an exchange can be liable for technical slip-ups. U.S. exchanges match hundreds of billions of dollars of securities transactions every day.
Knight's support comes after Nasdaq increased the payback fund to $62 million in cash from an earlier $40 million, made up mostly of trading rebates, the market-making firm said in a letter to the U.S. Securities and Exchange Commission, dated August 29.
Nasdaq has around 300 member firms that trade on the exchange. Knight and other retail market-making firms and brokers together lost more than $500 million in the IPO.
Of the handful of comment letters on the compensation plan, two have voiced support: Knight's and hedge fund Citadel's. Seven -- from market makers, brokers, and lawyers for individual investors -- have called for it to be rejected.
"Although we would have preferred that the accommodation pool cover all losses sustained by Nasdaq members, we do support Nasdaq's proposal," Knight said in the letter.
Knight, which facilitates trades for other firms, had called Nasdaq's earlier plan "inadequate," and said it was considering legal action over the Facebook IPO.
Liabilities at exchanges, which have some regulatory duties, are capped in most instances. Nasdaq's cap is $3 million.
Much of the debate around the plan has focused on whether Nasdaq should be able to cloak itself in regulatory immunity in situations where it is operating as a for-profit entity.
LIABILITY
Facebook's eagerly anticipated IPO on May 18, which raised $16 billion, was initially delayed by 30 minutes due to a technical glitch at Nasdaq.
The exchange then made the decision to get the stock trading by using a secondary system that ended up leading to delays in many clients orders and confirmations, costing some investors and traders big losses as the stock price dropped after an initial gain.
UBS AG, which disclosed it lost more than $350 million, and Citigroup's Automated Trading Desk, which is said to have lost up to $35 million, have argued that Nasdaq should be responsible for all of the losses, because the decision to move forward with the IPO was a business decision made in haste.
Further, Citi said trading of Facebook should not have been allowed to continue during the confusion that followed.
But Knight, which said it lost more than $35 million in the IPO, urged the SEC to leave the discussion of liability limitations and regulatory immunity to another day. Citadel, which is said to have lost $20 million, made a similar request.
RELEASE WAIVER
Knight did urge the SEC to reject a portion of Nasdaq's plan requiring firms that sign on to waive their right to sue the exchange, likely before they know how much they will be reimbursed. Knight said that would set "a harmful precedent."
"Setting forth those types of requirements in the context of a rule filing inappropriately mixes commercial issues with regulatory requirements," Knight said in the three-page letter also addressed to SEC Chairman Mary Schapiro.
It said if the SEC disagrees and determines that some form of release is appropriate, it should only be sought after Nasdaq members are notified of the amount Nasdaq is willing to pay under the terms of the accommodation plan.
A Nasdaq spokesman had no comment on Knight's letter.
Nasdaq also faces regulatory investigations into its systems and actions during the IPO.
Knight had its own trading glitch on August 1, costing the firm $440 million and nearly forcing it into bankruptcy before a group of independent firms saved it with a $400 million investment.

Home Depot (NYS: HD) investors put out the welcome mat for the home-improvement retailers good quarterly tidings, but lets not forget the foundation remains a bit shaky.
The company reported a better-than-expected profit. Second-quarter net income increased 12% to $1.53 billion, or $1.01 per share. Analysts had expected a profit of $0.97 per share. Home Depot also updated its fiscal 2012 guidance to reflect a better earnings outlook for the year, anticipating a 19% profit jump to $2.95 per share.
Although some customers might have shelled out more to pretty up their homes, Home Depots sales growth wasnt exactly robust. Same-store sales increased 2.1%, and comps in the US jumped 2.6%. Total sales increased just 1.7% to $20.6 billion.
It should be interesting to see how rival Lowes (NYS: LOW) compares when it reports its results on Aug. 20, but the second quarter is a significant one for home-improvement retailers. Warmer weather early this year resulted in some home-improvement spending transacted in the first quarter, but still, theres good reason to believe things will become far less bullish for companies like Home Depot during the rest of the year.
The macroeconomic outlook is choppy, and the housing market continues to plant a big question mark on the competitive landscape. This quarters earnings season has been touch-and-go as many consumer-facing stocks have faced frugal spenders and fickle shopping habits.
On one hand, Whole Foods Market (NAS: WFM) delivered a stellar surprise, but then stocks like McDonalds (NYS: MCD) and Chipotle (NYS: CMG) have had more disappointing quarterly tidings to share, and their share prices have receded quite a bit. The latter two look like bargains for savvy investors who are in stocks for the long haul. The current environment is putting some buy opportunities into investors shopping carts.
On the other hand, shares of Home Depot have risen about 60% in the past year; much of that share appreciation is probably hinged on investors hopes for an improving housing market. However, thats hardly a given in the near term. Meanwhile, Home Depot trades at 16 times forward earnings. You could argue thats not too unreasonable when weighed against growth expectations for the next two years, but then again, if the foundation is as shaky as I think it is, its too dear a price to pay.
When companies cut spending, repurchase shares, and boost earnings, it can seem heartening, but the truly bullish sign would be far more robust sales figures than Home Depot delivered. Investors should leave home improvement alone and go for other high-quality stocks whose prices have gotten the wrecking ball recently. Home Depots bubbly stock price has a lot to lose for the rest of the year.

Dinosaur fossils found with the bones of birds and small dinosaurs in their stomachs reveal the beasts may have been adept hunters capable of downing prey more than a third their own size, researchers say.
Fossils are occasionally found with the remains of animals and plants inside what were once their guts. These tummy contents can shed light on what they once ate ? for instance, past research showed a mammal predator apparently had a tiny dinosaur as its last meal.
Scientists investigated two specimens of a carnivorous dinosaur from Liaoning, China, known as Sinocalliopteryx gigas. The predator was roughly the size of a wolf, about 6 feet (2 meters) long, and had feathers or hairlike fuzz covering its body to help keep it warm.
Back when this dinosaur was alive, about 120 million years ago, the area was a warm, wet forest, with a diverse fauna of dinosaurs, birds and crocodilians. "It was kind of a quintessential dinosaur environment, with lots of volcanic activity that periodically inundated the landscape and buried things within it with exquisite preservation," said researcher Phil Bell, a vertebrate paleontologist at the Pipestone Creek Dinosaur Initiative in Canada. "Today the area is pretty much farmland, although the farmers all understand the importance of fossils and the interest they create, and a lot have turned to farming for dinosaurs."
One of the Sinocalliopteryx specimens, a complete and remarkably well-preserved skeleton, apparently dined on a birdlike, cat-size feathered dinosaur known as Sinornithosaurus, judging by the partial leg found in its gut. [See Images of the Dinosaur Guts]
The other Sinocalliopteryx specimen, an incomplete skeleton, held the remains of at least two primitive crow-size birds known as Confuciusornis, as well as acid-etched bones from a dinosaur. (Confuciusornis was probably limited to slow takeoffs and short flights.)
"Stomach remains are evidence of actual interactions between animals, which is extremely rare in the fossil record," Bell told LiveScience. "We're lucky to find one or two bones of anything; to get a specimen with the remains of its last meal or meals is pretty cool."
It remains uncertain whether the dinosaurs actively hunted or scavenged these meals. Still, the fact that Sinocalliopteryx gobbled at least two birds of the same species at about the same time "says chances are very good it was actively selecting its prey; that makes it a predator," Bell said.
And capturing flying prey points to a stealthy, capable hunter, the researchers added.

CAMBRIDGE, MA -- To control the three-dimensional shape of engineered tissue, researchers grow cells on tiny, sponge-like scaffolds. These devices can be implanted into patients or used in the lab to study tissue responses to potential drugs.
A team of researchers from MIT, Harvard University and Boston Children's Hospital has now added a new element to tissue scaffolds electronic sensors. These sensors, made of silicon nanowires, could be used to monitor electrical activity in the tissue surrounding the scaffold, control drug release or screen drug candidates for their effects on the beating of heart tissue.
The research, published online Aug. 26 in Nature Materials, could also pave the way for development of tissue-engineered hearts, says Robert Langer, the David H. Koch Institute Professor at MIT and a senior author of the paper.
"We are very excited about this study," Langer says. "It brings us one step closer to someday creating a tissue-engineered heart, and it shows how novel nanomaterials can play a role in this field."
Lead authors of the paper are Bozhi Tian, a former postdoc at MIT and Children's Hospital; Jia Liu, a Harvard graduate student; and Tal Dvir, a former MIT postdoc. Other senior authors are Daniel Kohane, director of the Laboratory for Biomaterials and Drug Delivery at Children's Hospital, and Charles Lieber, a Harvard professor of chemistry.
A 3-D system
Until now, the only cellular platforms that incorporated electronic sensors consisted of flat layers of cells grown on planar metal electrodes or transistors. Those two-dimensional systems do not accurately replicate natural tissue, so the research team set out to design a 3-D scaffold that could monitor electrical activity, allowing them to see how cells inside the structure would respond to specific drugs.
The researchers built their new scaffold out of epoxy, a nontoxic material that can take on a porous, 3-D structure. Silicon nanowires embedded in the scaffold carry electrical signals to and from cells grown within the structure.
"The scaffold is not just a mechanical support for cells, it contains multiple sensors. We seed cells into the scaffold and eventually it becomes a 3-D engineered tissue," Tian says.
The team chose silicon nanowires as its electronic sensors because they are small, stable, can be safely implanted into living tissue, and are more electrically sensitive than metal electrodes. The nanowires, which range in diameter from 30 to 80 nanometers (about 1,000 times smaller than that of a human hair), can detect voltages less than one-thousandth of a watt, which is the level of electricity that might be seen in a cell.
Monitoring cell behavior
In the Nature Materials study, the researchers used their scaffolds to grow cardiac, neural and muscle tissue. Using the engineered cardiac tissue, the researchers were able to monitor cells' response to noradrenalin, a stimulant that typically increases heart rate.
The team also grew blood vessels with embedded electronic sensors and showed they could be used to measure pH changes within and outside the vessels. Such implantable devices could allow doctors to monitor inflammation or other biochemical events in patients who receive the implants. Ultimately, the researchers would like to engineer tissues that can not only sense an electrical or chemical event, but also respond to it appropriately for example, by releasing a drug.
"It could be a closed feedback loop, much as our autonomic nervous system is," Kohane says. "The nervous system senses changes in some part of the body and sends a message to the central nervous system, which then sends a message back to take corrective action."
The team is now further studying the mechanical properties of the scaffolds and making plans to test them in animals.

These sensors, made of silicon nanowires, could be used to monitor electrical activity in the tissue surrounding the scaffold, control drug release or screen drug candidates for their effects on the beating of heart tissue.
The research, published online Aug. 26 in Nature Materials, could also pave the way for development of tissue-engineered hearts, says Robert Langer, the David H. Koch Institute Professor at MIT and a senior author of the paper.
"We are very excited about this study," Langer says. "It brings us one step closer to someday creating a tissue-engineered heart, and it shows how novel nanomaterials can play a role in this field."
Lead authors of the paper are Bozhi Tian, a former postdoc at MIT and Children's Hospital; Jia Liu, a Harvard graduate student; and Tal Dvir, a former MIT postdoc. Other senior authors are Daniel Kohane, director of the Laboratory for Biomaterials and Drug Delivery at Children's Hospital, and Charles Lieber, a Harvard professor of chemistry.
A 3-D system
Until now, the only cellular platforms that incorporated electronic sensors consisted of flat layers of cells grown on planar metal electrodes or transistors. Those two-dimensional systems do not accurately replicate natural tissue, so the research team set out to design a 3-D scaffold that could monitor electrical activity, allowing them to see how cells inside the structure would respond to specific drugs.
The researchers built their new scaffold out of epoxy, a nontoxic material that can take on a porous, 3-D structure. Silicon nanowires embedded in the scaffold carry electrical signals to and from cells grown within the structure.
"The scaffold is not just a mechanical support for cells, it contains multiple sensors. We seed cells into the scaffold and eventually it becomes a 3-D engineered tissue," Tian says.
The team chose silicon nanowires as its electronic sensors because they are small, stable, can be safely implanted into living tissue, and are more electrically sensitive than metal electrodes. The nanowires, which range in diameter from 30 to 80 nanometers (about 1,000 times smaller than that of a human hair), can detect voltages less than one-thousandth of a watt, which is the level of electricity that might be seen in a cell.
Monitoring cell behavior
In the Nature Materials study, the researchers used their scaffolds to grow cardiac, neural and muscle tissue. Using the engineered cardiac tissue, the researchers were able to monitor cells' response to noradrenalin, a stimulant that typically increases heart rate.
The team also grew blood vessels with embedded electronic sensors and showed they could be used to measure pH changes within and outside the vessels. Such implantable devices could allow doctors to monitor inflammation or other biochemical events in patients who receive the implants. Ultimately, the researchers would like to engineer tissues that can not only sense an electrical or chemical event, but also respond to it appropriately for example, by releasing a drug.
"It could be a closed feedback loop, much as our autonomic nervous system is," Kohane says. "The nervous system senses changes in some part of the body and sends a message to the central nervous system, which then sends a message back to take corrective action."
The team is now further studying the mechanical properties of the scaffolds and making plans to test them in animals.

Renal denervation improves blood pressure and arterial stiffness in patients with therapy resistant hypertension, according to research presented at ESC Congress 2012 by Mr Klaas Franzen from the University Hospital of Schleswig-Holstein. The findings suggest that renal denervation regenerates blood vessels and could reduce cardiovascular events.
Malignant arterial hypertension was historically treated with surgical thoracolumbar splanchnicectomy, a type of sympathectomy treatment that was introduced in 1938. "A significant reduction in blood pressure response was observed in at least half of the patients who underwent splanchnicectomy," said Mr Franzen. "But the treatment led to severe adverse events such as orthostatic hypotension, anhidrosis and intestinal disturbances. After the discovery of effective antihypertensive drugs, splanchnicectomy became neglected and disregarded over time."
In 2009 the concept of sympathectomy was reintroduced with intravasal catheter-based percutaneous renal sympathetic denervation (RDN) used in patients suffering from resistant arterial hypertension. Recent publications have shown that RDN significantly lowers systolic and diastolic peripheral brachial blood pressure by 32/12 mmHg after 6 months.
Mr Franzen said: "RDN with radiofrequency energy has several important advantages over surgical splanchnicectomy: it is a minimally invasive procedure without significant systematic side effects, it is well tolerated, and recovery times are short."
Arterial hypertension can irrevocably harm blood vessels in the short and long term, subsequently leading to increased aortic/arterial stiffness and arteriosclerosis. "Since central aortic pressures and arterial stiffness are much better predictors for future cardiovascular events than peripheral pressures we focused the present study on the effects of RDN on central hemodynamics and arterial stiffness," said Mr Franzen.
The researchers studied 21 patients with therapy resistant hypertension (61.9% men; mean age 64 years; 5.0?1.3 antihypertensive drugs) and 6 controls (83.3% men; mean age 57 years; 4.3?2.3 antihypertensive drugs). The inclusion criteria were: (i) use of >3 antihypertensive drugs, (ii) peripheral blood pressure at baseline ?150 mmHg, and (iii) exclusion of secondary hypertension and anatomical abnormalities of the renal arteries.
RDN was performed with an RDN radiofrequency ablation catheter system (1). Central hemodynamics and arterial stiffness, i.e. pulse wave velocity (PWV), were recorded with an Arteriograph device (2). Measurements were performed at baseline, and 3 and 6 months after the intervention.
RDN led to an improvement in all parameters compared to baseline. Peripheral systolic blood pressure improved by 7.6% (145 mmHg versus 156 mmHg, p<0.05) after 3 months and by 5.4% (148 mmHg versus 156 mmHg, p<0.05) after 6 months. Central systolic blood pressure improved by 9.5% (147 mmHg versus 161 mmHg, p<0.01) after 3 months and by 6.6% (151 mmHg versus 161 mmHg, p<0.05) after 6 months. Most importantly, PWV improved significantly, both at 3 months (9.4?1.2 m/s versus 10.9?1.8 m/s, p<0.01) and 6 months (9.7?1.8 m/s versus 10.9?1.8 m/s, p<0.01). Univariate analysis of variance (f-test) showed that the improvement of PWV was, at least in part, blood pressure independent.
In controls no significant changes in blood pressure values or PWV were observed.
"Besides peripheral blood pressures, RDN improved central blood pressures and arterial stiffness, i.e. PWV," said Mr Franzen. "According to age adjusted reference values, the improvement of approximately 1m/s PWV observed in our study could be interpreted as a blood vessel rejuvenation of almost 10 years. This suggests that RDN might be a fountain of youth for blood vessels in patients with therapy resistant hypertension."
He added: "Further studies are needed to determine whether the benefits of RDN translate into a reduced risk of cardiovascular events."

Over a cup of strong Turkish coffee in the nearby village of Tibnin, Fayed said his support for the militia ? and Syria ? was the result of the mistreatment of his fellow Lebanese by Israeli soldiers during the 22-year occupation of Lebanese territory before withdrawing in 2000.
Then war broke out in 2006. Despite the devastation wrought throughout Lebanon during the conflict, Hezbollah, with Syrian arms and support, managed to halt the advances of the most powerful army in the region.?
The war garnered Hezbollah?s leader, Hassan Nasrallah, widespread respect across the Arab World. Flags adorned with Hezbollah?s logo -- an arm holding an assault rifle, extending from the party?s name in green Arabic letters against a yellow background -- flies across the region and Nasrallah is now a household name.

?Assad helped us in our fight against the Israelis. Those who are fighting against him want to destroy the resistance,? Fayed said, ?But the resistance (against Israel) will prevail.?
The links between Hezbollah and Syria were stressed emphatically in July during a speech by Nasrallah who defended his support for the Assad regime.?

He highlighted how Syria had been an ally against Israel, supplying Hezbollah and the Palestinian militia Hamas with weapons used during the recent wars with Israel.?
?The Syrian leadership was risking its interests and existence in order for the resistance in Lebanon and Palestine to be strong. Show me one other Arab regime that does the same,? Nasrallah declared.
?Bashar [Assad] is a good man,? said Louay Hashem, a taxi driver from the southern town of Bint Jbeil. ?The people who are causing trouble in the country are the terrorists. They are sponsored by Qatar and Saudi Arabia who want to take over the country for their own interests.?
NBC's Richard Engel, who has just returned from his third trip inside Syria, since the uprising began, joins Andrea Mitchell Reports to discuss the situation on the ground.
These are views repeated time and again by Hezbollah supporters, and follow the narrative of news outlets such as Al Manar, a television station affiliated with the party.
?The resistance (to Israel) is the priority for the party,? explained Nicholas Blanford, a Hezbollah expert and author of Warriors of God: Inside Hezbollah's Thirty-Year Struggle Against Israel.

?The Assad regime forms part of the axis of resistance [together with Hezbollah and Iran] and its demise would be a significant blow to the axis,? he added.

According to Blanford, steadfast support by Hezbollah members for the party?s position on Syria is unsurprising considering the fact that the conflict is increasingly being seen as a regional battleground, with Hezbollah and Iran supporting the regime while Saudi Arabia, Qatar and other Gulf States back the rebels.
Further afield, Russia and China have repeatedly vetoed U.N. Security Council resolutions that Western and some Arab countries had hoped would pile pressure on Assad to end the conflict.
Fouad, a resident of Hezbollah?s Beirut stronghold of Dahiyeh, who asked for his full name to be withheld, described how Syria has always been a dependable ally in the group?s conflict with Israel ?unlike other traitor nations [in the region] that claim to support the resistance but in reality do not.?
Moreover, Fouad stressed the importance of Syria as a Shiite-friendly ally in a region dominated by Sunni governments.
According to Ali Wehbe, a mechanical engineering student and Hezbollah loyalist, the group supports calls by the Syrian people for regime reform, but feels that the conflict has been exploited by Western countries, Turkey and Gulf States to pursue their own agendas.?

Crucially, if Assad falls many believe a key pillar in the war against Israel will disappear.
So the methods employed by the Assad regime were harsh, but understandable, Wehbe said.
?Just as the Allies had to shell Germany to rid it of Hitler and his Nazi ideology [in World War II], the methods employed by the Assad regime are a tragic but necessary evil,? he said.
